Recently, a "online shopping" without my consent.

Order

The post was returned to a number of online communities, and the poster also released a full record of customer service complaints to some shoe and clothing network platforms.

One stone stirred up thousands of waves, and many followers were also "drying" their recent experience of being deleted without order in online shopping. They condemned the lack of honesty in online sellers.

Unlike real pactions, online shopping does not need to be delivered at first hand, but "orders" are often regarded as "quasi contracts" between buyers and sellers.

So, is it true that businesses have the right to delete orders from consumers and tear up the contract?

Order submitted 29 days after being deleted.

According to the poster Mr. Lin, he ordered a pair of online shopping platforms a year ago.

Snow boots

This is intended to be a gift for my mother's Spring Festival, but the order has not been received since it was submitted in January 15th.

During this period, Mr. Lin has repeatedly communicated with customer service through telephone and online shopping platform. Although he repeatedly received the reply that he would rush to rush to deal with the shipment, and "hurried to deal with it as soon as possible, please wait a moment," Mr. Lin has never been able to "meet" with the goods he ordered.

Finally, after waiting for 29 days, the Jingdong cut off the order by way of "delete orders", and completely ended the deal.

According to Mr. Lin's order number "142717293", the reporter dialed the customer service telephone, but his customer service personnel said that the order came from the seller of the third party seller and commissioned the Guangzhou post to deliver the goods. At present, the order has been deleted, and the corresponding amount has been returned to Mr. Lin's account.

The reason for the cancellation of the order is that the customer service staff of the shop said that because the distribution status of the goods was shown to be missing, and that the order had been over 20 days, the order of the Beijing east side was cancelled to avoid an automatic completion of the order within the specified time limit, resulting in no refund.

If Mr. Lin still wants to purchase this product, he will need to resubmit the order.

Mr. Lin said he could not understand the explanation of the online shopping platform.

As a result, orders were dragged for too long, and the image before the online shopping platform was quite inconsistent. Secondly, shoes were gifts for mothers. Although the Spring Festival has passed, they did not express their request to terminate orders, and online shopping platforms unilaterally cancelled orders.

Incidents of dishonesty happen frequently.

In fact, Lin's experience is not a case, and the consumer orders have been deleted.

In December 2011, the order of "mushroom" ordered by Mr. ho ho through another website was cancelled.

In the online shopping market, it is common for businesses to delete orders on the grounds of shortages and wrong prices. Although businesses can always find such or such reasons, they have seriously affected the credibility of online shopping.

According to industry sources, the online shopping market is chaotic. Many sellers and e-commerce providers have launched a low price marketing way to attract consumers. But when consumers rush to buy, businesses cancel the order on the grounds of shortage and shortage of stock.

The most impressive consumers should be the following events: dangling Adidas's shoes price 1 yuan, Samsung mobile phone price 110 yuan, the original price of 100 yuan book was marked 50 yuan......

After a large number of consumers ordered, the order submitted by consumers was deleted on the grounds that the price tag was wrong or the discount item was sold out.

As we all know, many shopping websites often sell low priced signboards, such as dollar rush, spike zone, limited time rush, etc. consumers are often attracted by these gimmicks, but there are very few "cheap ones" that can really be found, and the credibility is not verified. Moreover, because of the looseness of network management and supervision, it is very difficult for consumers to "find the back accounts".

Consumers can protect their rights in accordance with the law.

Whether the above events are a website error or a promotional gimmick, we have no idea. But does the unilateral deletion of orders by online sellers infringe on the rights and interests of consumers?

The legal consultant of Beijing Ying Ke law firm told reporters that the order generated by online shopping is also a contract. If the price is wrong or out of stock, the business is negligent, and the mistake is not in the consumer, so consumers can ask the merchant to continue to fulfill the original order.

However, consumers want to protect their rights, but there is a difficult problem of obtaining evidence. Because the shopping web pages can be modified or deleted at any time, the evidence that consumers can provide is to crawl web pages or to give evidence by other consumers, but the effectiveness of these evidence is not enough, making consumers' rights and interests difficult.

Moreover, some businesses refuse to compensate or compensate consumers on the grounds of website agreement.

For example, in the user agreement of electricity suppliers, there will be ordinances for "if the shortage of electricity providers has the right to cancel orders".

In this regard, Zhao Zhanling, the chief legal adviser of China Internet legal network, believes that because of the lack of information, the consumers are opaque and vague. Whether they are out of stock can only be known by the electricity suppliers or sellers themselves. Therefore, this Ordinance is suspected of being a king clause and does not have the legal effect of exemption from business.

Zhao Zhanling said that for some businesses without integrity, in addition to pursuing civil liability, they should also give certain administrative responsibilities to the legislation, link the dishonest behavior with qualification, and establish a good faith mechanism of online shopping through legislation.
