Camel

Ming Ming bought the "Camel" casual shoes that American companies authorized the production and promotion of domestic enterprises, but later discovered that the shoes were genuine Chinese "blood".

To this end, the lawyer who bought this shoe thinks that this is a Chinese brand but not packaged into an American brand for sale. The actions of its manufacturers and distributors have constituted a fraud against consumers. The Fujian Shishi Hao shoe industry Co., Ltd. and Beijing Hualian comprehensive supermarket share company Shijingshan branch went to court together to request twice the purchase of shoes.

The case was recently heard at the people's Court of Shijingshan District, Beijing.

According to Zhang lawyer, in the spring of 2008, he went shopping in Shijingshan Hualian, and found that "American Camel" casual shoes were found in the two floor leather shoes store.

The store is marked with red "Camel", which is very attractive. Many locations in the counters and shoe boxes are marked with the words "American Camel" and "American Camel International Invest Enterprise Ltd (authorized)". It also indicates that the authorized person is Shishi Hao shoe industry Co., Ltd., and the manufacturer is Shishi Hao Mei Shoes Co., Ltd.

According to these information, Zhang believes that "American Camel" is a brand of an American company and bought a pair of casual shoes for the brand out of its recognition and trust in the brand of American companies.

However, after consulting the relevant information about trademark registration of "American Camel" leather shoes, Zhang found that the registered trademark of camel trademark and graph is a Chinese citizen with 10000 surnames, rather than the so-called American Camel International Invest Enterprise Ltd.

For professional reasons, Lawyer Zhang collected data related to the trademark, and found that the camel logo and map were indeed registered by Wan Mou in China. But in April 2003, the trademark owner Wan Mou authorized the right to the use of the trademark to the US camel investment company and prepared the case.

In 2005, the camel investment company in the United States changed its camel logo and map to Shishi Hao Shoe Co., Ltd., so that the "Camel" leather shoes now sold in the market are available.

"The ordinary camel registered by a Chinese person has been carefully packaged into an American Camel," Zhang said.

This approach has objectively achieved the expected commercial publicity effect, making consumers mistaken that camel brand is the brand of American companies.

Therefore, the sale and sale of these casual shoes by the sellers and manufacturers of camel casual shoes have constituted a fraud on consumers. Therefore, the two defendants are required to double return their purchase shoes and require the original information of the manufacturers' real standard trademarks.

For this reason, the Shijingshan Hualian company, which was promoted to the defendant's seat because of the sale of "Camel Leather shoes", said that the "American Camel" casual shoes sold in the store are in the American brand or Chinese brand, not within the scope of their own examination.

However, the manufacturer of Shishi Hao Mei Shoes Co., Ltd. raised objection to the jurisdiction and did not make substantive reply.

In his trial, Zhang said that the purpose of his prosecution is to prompt producers and sellers to sell products in a similar way like "American Camel" casual shoes, and it is hoped that relevant departments will regulate relevant trademarks and information.
