WTO Determination Of Export Restrictions On Raw Materials

China regrets the ruling


The head of the treaty and Law Department of the Ministry of Commerce said in a statement that it was regretted that the expert group ruled that the export duties and export quota measures of the Chinese side were not in line with the commitments made by the Chinese side to join WTO and the relevant WTO rules, and did not meet the conditions of protecting the exceptions such as the exhaustion of natural resources and the protection of human life and health.


He pointed out that in order to protect the environment and make full use of natural resources, the Chinese government has strengthened management measures for some resource products, especially those with high pollution, high energy consumption and resource consumption in recent years. China believes that although the implementation of these measures has certain impact on users at home and abroad, it is in line with the sustainable development goals advocated by WTO, and is conducive to promoting the healthy development of resource industries. China will implement scientific management of resource products according to the WTO rules, maintain fair competition and promote sustainable development.


In July 5th, WTO sent members' reports to the group of experts on export restrictions on raw materials in the United States, the European Union and Mexico. The expert group made a ruling on 7 aspects, namely, the scope of examination, export tariffs, export quotas, the Chinese defense of the exception clauses, the allocation and management of export quotas, the issuance of export licenses, and the minimum export limit.


It is understood that in the framework of WTO, China can appeal against the current expert panel rulings. In accordance with the procedures, after the Chinese side formally appeals to WTO, the WTO dispute settlement body will issue a final ruling in half a year. The Ministry of Commerce said that the Chinese side is currently evaluating the panel's award report and will follow the WTO dispute settlement procedure properly.


Rare earth or the next target


Although the 9 kinds of raw materials litigation does not include rare earth products, China's rare earth policy has been at the cusp of the storm. Since last year, the export quota of China's rare earth has been reduced, and at 2011, the provisional tax rate for the export of rare earth metals is 15%, and the provisional tax rate for the export of rare earth neodymium has increased from 15% to 25%, which has caused a great stir in many countries.


EU Trade Commissioner Teguh Hurt has said that the EU will take action against China's massive government subsidy projects to protect China's low-priced products from unfair subsidies into the European market and pose a threat to related industries.


In particular, the issue of rare earth, Teguh Hurt claims that there is no legal basis to challenge China's rare earth policy yet, but the EU will seek other sources of supply, while demanding that China guarantee the EU's demand for rare earth.


The Ministry of Commerce said that after the United States, the European Union and Mexico filed lawsuits against 9 products that limit the export of raw materials, rare earth may also become their next litigation goal.


A researcher at the Ministry of Foreign Economic Research of the National Research Center told reporters that rare earth is a strategic material. The joint action of some countries is not entirely from an economic point of view, but with a deeper intention.


Yao Jian, spokesman of the Ministry of Commerce, stressed on many occasions that China's rare earth trade policy and industrial policy are closely related, and its basic foothold is sustainable development and environmental protection. China uses about 30% of the world's reserves to provide 90% of the market size and trade scale. "We hope to further develop new reserves through international cooperation in the future, and provide support for the relevant industries in the world. China will take a responsible attitude towards international rare earth resources cooperation to ensure basic market supply. " Yao Jian said.
